An army major yesterday offered the first testimony in a United States military war crimes proceeding since the end of World War II, describing the capture of Osama bin Laden's former driver, Salim Ahmed Hamdan, in a small town in Afghanistan.
Major Henry Smith's testimony came during a pretrial hearing to determine whether Hamdan is an unlawful enemy combatant who can be tried on war crimes charges in a United States military tribunal set up to judge prisoners captured in the war on terrorism.
