DARWIN - Australian truck driver Bradley John Murdoch will stay behind bars after losing an appeal against his conviction and life sentence for the outback murder of British tourist Peter Falconio.
Murdoch, 48, was convicted in 2005 of murdering Falconio and kidnapping his girlfriend Joanne Lees on a remote outback highway in the Northern Territory in 2001.
Murdoch's lawyers told the Northern Territory Supreme Court in Darwin that there had been a substantial miscarriage of justice and that photographic identification evidence should not have been presented during the 2005 trial.
The prosecution said Murdoch shot Falconio, but his body was never found and neither was a murder weapon.
Lees said Murdoch put a gun to her face and tied her up, but she escaped into bushes and was later picked up by a passing truck driver.
