The United States Government decided not to seek a fifth racketeering trial against John "Junior" Gotti, son of the notorious Gambino family crime boss who also was noted for avoiding conviction.
Prosecutors in New York said they decided not to seek another trial "in light of the circumstances".
Gotti has been free on US$2 million ($2.7 million) bail since a jury became deadlocked on December 1 after deliberating for 11 days, forcing a mistrial. Three trials in 2005 and 2006 also ended in hung juries.
