Australian immigration lawyers who lose their cases will have costs awarded against them personally if legislation is passed by Parliament.
Attorney-General Philip Ruddock said the law was needed to clear a backlog of migration cases.
He believes detention times would be slashed if immigration advocates stopped clogging up court lists with unmeritorious cases simply to buy time for people who would otherwise have to leave the country.
