A convicted Victorian sex offender challenging a ruling that denies him access to IVF treatment was a low risk of reoffending, a tribunal has been told.
The man, 33, has gone to the Victorian Civil and Administrative Tribunal to challenge the findings of a review panel which says sex offenders cannot access IVF.
Only Victoria has laws where sex offenders must argue why they can access IVF.
The man who is challenging the ruling in what his lawyers have said is an Australian first test case, was convicted in 2008 of having sex with a 16-year-old girl under his care when he was a teacher's aide.
He spent a year in jail.
Two psychologists who assessed the man told VCAT he posed a low risk of sexual reoffending.
Psychologist Danny Sullivan said it was "extremely unlikely" he would have difficulty discerning the boundary between parent and child.
The hearing is continuing.
