Re: Louis Vuitton Cup Yacht Substitution
This morning we received a media enquiry regarding the rights of challengers to substitute their competing yachts between series.
Upon checking the relevant rules, we ascertained that there is a conflict between the Louis Vuitton Cup Conditions and the Protocol relating to the right to substitute between the end of the semi-finals and the commencement of the final in the Louis Vuitton Cup.
Condition 10.1(g) permits yacht substitution between the semi-finals repechage and the public unveiling ceremony prior to the finals. However, Article 6.2(c) of the Protocol states: "The finals of the challenge selection series will be between the top yachts in the semi-finals."
When there is conflict the Protocol takes precedence over the Conditions.
It is therefore our view that the wording of Article 6.2(c) of the Protocol means that substitution is not permitted between the semi-finals and the finals of the Louis Vuitton Cup.
If the Protocol had intended to allow for substitution the wording of 6.2(c) would have referred to the "two top yacht clubs" not "the two top yachts".
In view of the wording of the Louis Vuitton Cup Conditions and the current position with the regatta, we consider it important that the competing challengers receive notice of this matter as soon as possible.
