Oracle Racing say Prada have breached America's Cup protocol by taking them to the High Court at Auckland - just over three months from the start of the Challenger series.
Italians Prada and American billionaire Larry Ellison's syndicate Oracle, who are located side by side on Halsey St in the Viaduct Basin, are caught up in a legal wrangle in which Prada accuse Oracle of invading their privacy.
But Article 10 of the America's Cup Protocol states that any challenger who resorts to court or tribunal other than the Arbitration Panel or any other dispute body agreed by the Royal New Zealand Yacht Squadron and the Challenger of Record will be in breach of the protocol.
That breach would make Prada ineligible to challenge for the America's Cup against Team New Zealand, should they win the Louis Vuitton Challenger series, which starts on October 1.
The case is still before the High Court and the panel refuses to give any answers on disputes until they are guaranteed not to be sued.
