The Auckland Rugby Union holds the key to Carlos Spencer's move to Northampton Saints.
Spencer is signed to the union for another year and only they have the power to prevent his imminent offshore move.
New Zealand Rugby Union deputy chief executive Steve Tew said the national body had held informal talks with Carlos Spencer and his manager David Jones before they left for the UK, but had not heard from them since.
Tew said they were not in a position to do anything more until Spencer outlined his plans to them and the NZRU were not certain the 29-year-old was back in the country yesterday.
Auckland chief David White was in South Africa yesterday and couldn't be reached for comment.
If Auckland Rugby are happy for Spencer to break his contract a year early the NZRU would not say 'no' to granting the player an early release.
The All Black coaches would also have to give their blessing to an early release but it is understood they are sympathetic to Spencer's desire to play in England after more than 10 years of service in New Zealand.
Auckland have Tasesa Lavea on their books and a number of other promising first five-eighths ready to replace Spencer, who reportedly wants to leave immediately after the Super 12.
The only issue over the highly paid, 35-cap All Black, could be over compensation.
The mercurial first five-eighth was in England last week and it is believed he has come to terms with struggling Northampton, although London Irish were
also chasing his signature.
Northampton's millionaire owner, Keith Barwell, admitted: "We have signed a world-class player that we haven't announced, but he has signed on whether we are relegated or not."
However, on Spencer's personal website he released a note denying he had signed for anybody.
"Contrary to popular belief Carlos has not signed with any English club," the statement said. "He has had offers on the table from leading clubs and has recently been to the UK to have a look at facilities and meet club officials.
"At this stage NO DECISION has been made on his future. Carlos will announce his decision personally via the website as soon as he has had a chance to weigh everything up and discuss with his family."
All Black selector Wayne Smith said there may still be room for Spencer or long-time rival Andrew Mehrtens as back-up to Daniel Carter against the Lions. However, Mehrtens may have the inside running. It remains to be seen whether Spencer may get game time against the Hurricanes on Friday, perhaps his last game for the Blues on Eden Park.
