Leading jockey Lisa Cropp's appeal over the legality of a failed drug test has been rejected by the Court of Appeal. In a judgment yesterday, the court dismissed the appeal and ordered Cropp to pay NZ Thoroughbred Racing $6000 in costs.
Cropp tested positive to methamphetamine in a random test at a Te Rapa meeting in 2005. The case went to the High Court at Auckland last March, where her lawyers argued that the drug test was unlawful and applied for a judicial review of Thoroughbred Racing's testing procedures.
A judicial committee had ruled in February that the procedures were valid and Cropp had a case to answer. Justice Pamela Andrews dismissed Cropp's case against the committee.
Last month, Cropp's lawyer, Alan Ivory, told the Court of Appeal that such a test interfered with the fundamental right of people to refuse to give bodily samples. The case is expected to return to a racing industry judicial committee.
