Promotion Terms and Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to New Zealand residents, aged 18 years or over. Employees (and their immediate families) of the Promoter, APN New Zealand Ltd and marketing and advertising agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Incomplete or indecipherable entries will be deemed invalid.
5. The promoter takes no responsibility for lost, stolen, misdirected or incomplete entries.
6. You may enter as many times as you like but entries must be received in separate envelopes to be valid.
7. All entries must be received by Friday 11 April 2008 at 5pm.
There are two ways to enter: 1: Go to the web address (specified on the competition ad printed in the Herald between 31 March and 5 April 2008) and enter your details. 2. Complete one of the entry forms printed in The New Zealand Herald between Monday 31 March and Saturday 5 April 2008 and post to: "P&O Summer Daydream Competition, The New Zealand Herald, Marketing Department, PO Box 3290, Auckland" by 5pm, Friday 11 April 2008. Entrants may enter as often as they wish, but each entry must include one of the entry coupons completed with the entrant's details (no photocopies accepted). Multiple entries must each be in separate envelopes.
The winners will be drawn on Monday 14 April 2008 and the winners will be notified by telephone in the first instance and then a confirmation letter will be posted out.
8. The first two (2) valid and correct entries drawn will win the major prize of a Pacific Sun cruise for 2 adults, for 8 nights, valued at up to AUD$5,200. Prize includes 8 nights twin share outside cabin accommodation, breakfast, lunch and dinner daily at the winner's choice of available restaurants on the cruise ship and any on board entertainment. Restaurants chosen by the winner may include a cover charge. The cover charge is the responsibility of the winner. Spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The major prize winners (and any companions) are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
9. The major prize must be taken on Pacific Sun cruise N827 departing Auckland, New Zealand on 23 July 2008.
10. The major prize is subject to the standard terms and conditions of individual prize and service providers. Subject to the terms and conditions of the participating major prize provider(s), if for any reason a winner does not, once the major prize has been booked, take the major prize or an element of the major prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
11. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
12. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
13. Total prize pool value is up to AUD$10,400. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
15. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet Service Provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.
17. As a condition of accepting the major prize, the winner (and any companion) must sign any legal documentation as and in the form required by the Promoter / Prize Supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form.
18. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
