Terms and Conditions - Z Hawaiian Adventure Cruise promotion

HOW TO ENTER:

Purchase The New Zealand Herald, Weekend Herald or Herald on Sunday at participating Z Energy sites between Monday, November 4, and Sunday, December 1, 2013, swipe your Fly Buys card at the time of purchase and you will be automatically entered in the draw to a Hawaiian Adventure Cruise for two.

One (1) winner will be drawn for this promotion. The Winner will be drawn on or before Friday, December 8, 2013.

TERMS OF ENTRY

1. Information on How to Enter and all details on the entry form (web) and at point of sale form part of these Terms. To the extent of any inconsistency, the Terms below prevail. By entering, you accept these Terms.
2. Entry into this Competition indicates an acceptance and agreement of all these terms & conditions. If you do not agree to these terms and conditions you should not enter the Competition.
3. Entry is open to NZ residents only. Anyone employed by (and any immediate family member of someone employed by) APN New Zealand Ltd, Cruise World and any agencies associated with these companies or with the promotion and Herald retailers are ineligible to enter. APN is APN New Zealand Limited (and its related companies). If the winner is under the age of 18 years the prize(s) will be awarded to the winner's parent(s) or guardian(s).
4. There will be one (1) winner and the one (1) winner will win a Hawaiian adventure cruise travel package for (2) two. The travel package includes:
- A 7 night Hawaiian Seascapes cruise for two (2) people on UnCruise's ship Safari Explorer
- Exclusive transfers and baggage handling from the airport to ship and vice versa where applicable
- All onboard meals
- Premium spirits, wine and beer onboard
- Port fees and taxes
- Entries into National Parks/preserves
- Use of all from-the-yacht adventure activities and equipment as well as sauna, fitness equipment, yoga and a complimentary massage.
- Return airfares to Hawaii from Auckland
- 4 nights accommodation at a 4 star hotel
- Airport taxes
Total RRP value: $15,500

Prize does not include crew gratuities at the discretion of the prize winners. The guidelines of gratuities on Uncruise are 5-10% of the actual cruise cost retail price.

5. The company's condition of carriage as recited on its ticket applies. The tickets are not transferable to other passengers, cannot be upgraded, nor exchanged or refundable in cash.
6. The airline tickets are valid for travel on the sector specified and not exchangeable for other routing and are not applicable for open dated air ticket(s). Hotel accommodation, transfers and cruise are for the named establishments only and cannot be exchanged.
7. Voluntary stopover other than specified in the itinerary outlined will not be allowed.
8. Travel is valid on Hawaiian Airlines operated services only. This excludes travels on Hawaiian Airlines joint operations and code share services operated by our airline partners. Any surcharges other than stated above ie excess baggage fees will be borne by the passenger(s).
9. All out of pocket expenses, insurance, passport fees, visas where applicable, transport to and from departure point, transfers and all other ancillary costs are the responsibility of the winners. The validity for travel redemption is for departures between January 04 2014 and April 12 2014 and between November 8, 2014 and April 4 , 2015. No extension is allowed.
10. Travel is subject to flight availability, flight restrictions hotel and cruise availability. Cruise is confirmable 60 days prior to departure, based on availability. Travel is not permitted during peak travel periods including New Zealand School and Public Holidays.
11. The travel validity of the ticket is 30 days from date of departure.
12. A minimum of one month's notice is required for bookings.
13. Ticket must be issued by Cruise World, Auckland.
14. Cruise World will book all accommodation and will provide the winner with a detailed itinerary.
15. Hawaiian Airlines Frequent Flyer miles are not applicable.
16. Baggage allowance is 23 kg per person.
17. Date changes are not permitted once booking has been made
18. The winner and their travel companion must ensure that their passports have a minimum validity of six months before travelling and any visa requirements are the responsibility of the winner.
19. Cruise World reserves the right to change any Terms & Conditions without any prior notice.
20. Compliance with any health or other government requirements is the responsibility of each winner and their travel companion.

21. The winner will be notified by phone and confirmed in writing, using the details listed on the Fly Buys database. Entrants should ensure that their personal details on the Fly Buys database are correct. If the winner cannot be contacted or does not claim the prize within 48 hours of the prize draw, that winner will forfeit the prize and a redraw will be made.
22. The Promoter, Z Energy Limited ("Z Energy") and Cruise World reserve the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process, including but not limited to making multiple entries that are not associated with the purchase of a Promotion Product, or for submitting an entry that is not in accordance with these Terms and Conditions.
23. The judges' decision is final and no correspondence will be entered into.
24. The Promoter, Z Energy and Cruise World reserve the right to vary any of the terms of entry applying to this promotion or to modify, terminate, suspend or reschedule this promotion.
25. Prizes are not exchangeable, not transferable and not redeemable for cash.
26. The Promoter, Z Energy and Cruise World accept no responsibility for late, lost or misdirected entries, or entries not correctly lodged through the Fly Buys system.
27. The Promoter, Z Energy or Cruise World are not responsible for the transmission or receipt of any incorrect information associated with entries, either caused by user error or any equipment or programming malfunction associated with the promotion.
28. The Promoter, Z Energy or Cruise World shall not be liable for any loss, damage or personal injury (including but not limited to indirect or consequential loss) suffered by any person arising directly or indirectly out of or in connection with entering this promotion or claiming/winning any prize, except as required by law.
29. All entries remain the property of Loyalty New Zealand Ltd ("Fly Buys"). All personal information will be collected and stored by Fly Buys in accordance with the Privacy Act 1993. You have the right to access your personal information and request correction of any errors in it pursuant to the Privacy Act 1993. Fly Buys may use entrants' personal information from entries to conduct the promotion and for its own future promotional and publicity purposes in accordance with standard Fly Buys Terms and Conditions. 30. By entering this promotion entrants consent to the use of their information as described in (29) above.
31. The winner's name and photo may be used for publicity purposes and by accepting the prize the winner(s) agrees to make them self available for this purpose.
