2. Entry is only open to New Zealand residents, aged 18 years or over. Employees (and their immediate families) of the Promoter, Cathay Pacific Airways, Hong Kong Tourism Board, Hotel Jen and WorldHotels and marketing and advertising agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Incomplete or indecipherable entries will be deemed invalid.
5. The promoter takes no responsibility for lost, stolen, misdirected or incomplete entries.
6. You may enter as many times as you like but entries must be received in separate envelopes or emails to be valid.
7. All entries must be received by 5pm, Thursday February 26, 2009.
There are two ways to enter: 1: Complete the entry coupon in the Herald on Sunday issues of February 15, or February 22 and post mail it in before 5pm, Thursday February 26, 2009. 2: Enter at www.nzherald.co.nz, by 5pm, Thursday February 26, 2009. Entrants may enter as often as they wish, but each must be via a separate coupon or online entry. There is one prize and not matter how many times the winner has entered they are entitled to only one prize.
The winner will be drawn on Wednesday March 11 and the winner will be notified by telephone as listed in the entry form submitted in the first instance, then a confirmation letter will be posted out to the address as listed in the entry form submitted.
8. The first valid and correct entry drawn will win the prize of return flights for two people flying economy class with Cathay Pacific Airways from Auckland to Hong Kong, airport/hotel/airport transfers in Hong Kong, four nights hotel accommodation at Hotel Jen in Hong Kong and two Hong Kong tours for two people. Spending money, meals, insurance, transport to and from departure point, items of a personal nature, in-room charges, air taxes, transfer fees (other than specified), excess baggage, government taxes, airport charges and any other personal expenses, including but not limited to travel insurances, not specified in the prize package must be paid for by the winner. Black-out dates apply. Dates for flights, accommodation and tours are subject to availability and bookings are essential.
The prize winners (and any companions) are responsible for ensuring they have valid passports, and any requisite visas, vaccinations and travel documentation.
9. The prize must be taken between the dates of August 1 and November 30, 2009.
10. The prize is subject to the standard terms and conditions of individual prize and service providers. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
Tickets are not eligible for any frequent flyer (including Airpoints Dollars) accrual, upgrade, companion redemption or credit towards tier status.
11. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
12. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
13. Total prize pool value is up to NZ$6,858.04. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
15. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.
17. As a condition of accepting the major prize, the winner (and any companion) must sign any legal documentation as and in the form required by the Promoter / Prize Supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form.
18. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
