Terms and Conditions for the Auckland Cup Week Magazine "Win a Fabulous Auckland Cup Week Experience" promotion

TERMS and CONDITIONS for the "Win a Fabulous Auckland Cup Week Experience" promotion, as seen in the Auckland Cup Week Magazine published by The New Zealand Herald on Thursday, 18 March, 2010.


1. Information on How to Enter and all details on the competition ad form part of these Terms. To the extent of any inconsistency, the Terms below prevail. By entering, readers accept these Terms. Entry is open to NZ residents aged 18 years and over only. Anyone employed by (and any immediate family member of someone employed by) APN, SKYCITY, Lion-Nathan or Lion-Nathan's agencies associated with this promotion are ineligible to enter. APN is APN New Zealand Limited (and its related companies).

2. Entries close 5pm, Wednesday, February 24, 2010. Readers may enter as many times as they like, but each entry must contain an original entry coupon (no photocopies accepted). The draw will take place on Wednesday, February 24, 2010 after 5pm.

3. The first entry randomly drawn will win the "Fabulous Auckland Cup Week" prize package, which is; 1) Four (4) tickets to the SKYCITY Auckland Cup Week Diamond Ball on Thursday, March 4, 2010. 2) One (1) night's accommodation for four (4) people (in two rooms) at SKYCITY Grand Hotel on Thursday, March 4, 2010, including buffett breakfast at The Terrace restaurant. 3) A chauffeur driven Mercedes E-Class to drive the promotion winners from one Auckland location that is no more than 50km to SKYCITY Grand Hotel for check-in on Thursday, March 4, 2010. 5) Four (4) tickets to the Stella Artois Garden Party at Auckland Cup Week, to be redeemed on either March 6 or March 10, 2010.

4. The prize is as stated and all supplementary costs are to be incurred by the winner All costs, charges and expenses (other than stated), including, without limitation, transportation, medical expenses, travel insurance, items of a personal nature, meals and beverages, laundry, telephone calls, additional nights or room upgrades etc., are the sole responsibility of the winner or his/her guests.

5. The winner and his/her guest(s) must take the prize together.

6. If any part of the prize is not used, for any reason beyond the organisers' control, no compensation will be awarded to the winner or to his/her guest.

7. Prize is not redeemable for cash. Any attempt to resell or auction all or part of this prize will result in immediate cancellation of the prize.

8. The prizewinners will be notified by phone. If the prize is not claimed within 2 days of the draw, APN may re-draw a new winner of the prize. APN's decision is final and no correspondence will be entered into.

9. Neither APN, SKYCITY or Lion-Nathan are liable for any loss, damage or injury (including without limitation indirect or consequential loss) suffered by any person in connection with the promotion or any prize, except for any liability under the Consumer Guarantees Act 1993 or other liability that cannot be excluded by law.

10. All entries are deemed received at the time of receipt by APN. Late, lost, stolen, misdirected, illegal, incomplete, illegible, damaged, reproduced, or altered entries are invalid. APN is not responsible for such entries.

11. APN reserves the right to vary these Terms or to modify, suspend, terminate or cancel the promotion.

12. APN reserves the right to verify the validity of any entry. APN may disqualify any person who tampers with the process or fails to comply with these Terms.

13. Entries become the property of APN. In accordance with the Privacy Act 1993, APN collects and holds personal information to conduct the promotion, notify prize winners and verify prize winners' identities and the information may be used for future promotional activities. Individuals have rights to access and request correction of their personal information held by APN by calling 0800 100 888. Failure to provide all requested personal information might result in the entry being invalid.

14. By accepting the prize, the winner consents to the promoter using his/her details and photographs for promotional and media publicity purposes.
