TERMS AND CONDITIONS FOR THE BE IN TO WIN THE ULTIMATE FAMILY HOLIDAY COMPETITION
1.Information on How to Enter and all details and instructions appearing on the entry form and at point of sale, forms part of the terms and conditions of entry to this Competition. To the extent of any inconsistency in the information on How to Enter and other details and instructions, the Terms and Conditions below will prevail.
2.Entry into this Competition indicates an acceptance and agreement of all these terms & conditions. If you do not agree to these terms and conditions you should not enter the Competition.
3.Entry is open to NZ residents except employees (and such employees' immediate families) of APN New Zealand Limited, The Red Group Retail (Whitcoulls & Borders), Village Roadshow, Pacific Blue and their agencies associated with the promotion and Herald retailers. Failure to provide all requested personal information at the time of submitting an entry may result in the entry being invalid. If the main prize winner drawn is under the age of 18 years the prize will be awarded to their parent or guardian.
4.To enter, purchase The New Zealand Herald, Weekend Herald or Herald on Sunday, any day from Monday, January 31 until Sunday, February 27, 2011 at any participating Whitcoulls or Borders branded outlet and an entry form will be automatically printed with your receipt. Then simply complete the entry form and hand this to a customer service representative.
5.In-store entries must be received by midnight Sunday, February 27 2011. Entrants may enter as often as they wish, but each entry must be on a separate entry form provided at the point of purchase and accompanied by a separate original proof of purchase (receipt).
6.Each completed and valid entry form will be entered into the draw to win. Entries not complying with these Terms and Conditions, and any late, lost, stolen, misdirected, illegal, incomplete, illegible, damaged, reproduced, or altered entries, will be deemed invalid. The Herald reserves the right to verify the validity of any entry.
Prize Details: There is one (1) family holiday package for four (4) to be won. This travel package includes;
- Return flights from Auckland/Wellington or Christchurch to the Gold Coast/Brisbane based on flight schedule and availibility for a family of four (including all taxes and surcharges)
- Accommodation for 7 nights at Sea World Resort & Water Park (room layout - 2 double beds)
- Family passes to Sea World, Movie World, Wet 'n' Wild and Australian Outback Spectacular 2 (Evening Dinner Show).
This Travel prize needs to be used prior to 31 August, 2011. Travel is not transferable from initial winner and is for four (4) people, this can be made up of two (2) adults and two (2) children, one (1) adult and three (3) children. Additional people are available on request and are at an additional charge. The four (4) travellers must travel together at all times and names will be notified to the participating operators.
7.It is each winner's responsibility to cover any additional costs associated with the prize not specifically stated in clause 6, and to arrange passports, visas and insurance. All travel prizes exclude travel/transport to and from Auckland, Wellington or Christchurch airports, departures taxes, meals and beverages. Additional spending money and all other ancillary costs are the responsibility of the winner unless otherwise stated.
8.In the event that any prize(s) become unavailable for any reason beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value. The prize is not transferable or exchangeable and cannot be taken as cash. Any unused portion of the prize is non-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.
9.In the event the prize winner requests a travel prize of greater value than that specified (eg: requests an extended length of stay), the prize-winner shall pay the difference in value and no claim for the difference shall be made against any of the promotional partners.
10.Taking the prize is subject to any prevailing terms and conditions of the accommodation/ transport/ services or transfers (as applicable), and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the winner, or their travel companions, are unable to use any element of the prize as stated for whatever reason, including participation in certain activities for health, age, behaviour or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
11.The winner and their travel companion will not accrue any frequent flyer points from taking the prize. All components of the prize must be taken together. Any element of the prize not taken will be deemed to be forfeited. Accommodation and travel is subject to booking, accommodation and flight availability. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner.
12.The prize draw will take place on or before Friday, March 25, 2011.
13.The winners will be notified by phone and confirmed in writing. If the winner cannot be contacted or does not claim the prize within 28 days of the prize draw, that winner will forfeit the prize and a redraw will be made.
14.The judges' decision is final and no correspondence will be entered into.
15.Prizes are not exchangeable, not transferable and not redeemable for cash.
16.The Herald (and its related companies) accepts no responsibility for late, lost or misdirected mail and will not be liable to any person in any way in relation to this Competition or the prize(s) (including but not limited to personal injury) except for any liability that cannot be excluded by law.
17.Each person who enters the competition acknowledges that no representations as to the quality or fitness for purpose of the prize has been made by the Herald or any representative of the Herald.
18.All entries become the property of NZ Herald. NZ Herald collects and holds personal information provided with each entry, to be used to notify prize winner, to verify prize winner's identity and, unless otherwise requested may be used for future promotional activities conducted by the NZ Herald. Under the Privacy Act 1993, all individuals have rights to access to and correction of their personal information held by the Herald at 46 Albert Street, Auckland by contacting NZ Herald on 0800 100 888 during business hours. Failure to provide all requested personal information at the time of submitting an entry may result in the entry being invalid.
19.The winner's name and photo may be used for publicity purposes and by accepting the prize the winner must make himself/herself available for this purpose.
