Terms and Conditions
1. Information on How to Enter and all details and instructions appearing on the entry form and at point of sale, forms part of the terms and conditions of entry to this Competition. To the extent of any inconsistency in the information on How to Enter and other details and instructions, the Terms and Conditions below will prevail.
2. Entry into this Competition indicates an acceptance and agreement of all these terms & conditions. If you do not agree to these terms and conditions you should not enter the Competition.
3. Entry is open to NZ residents except employees (and such employees' immediate families) of APN New Zealand Limited (NZ Herald), Kia, Mobil branded retail stores (including, without limitation independent dealers, lease dealers, franchisees, and commission agents) Mobil Oil New Zealand Limited and all related companies and their agencies associated with the promotion. Failure to provide all requested personal information at the time of submitting an entry may result in the entry being invalid.
4. To enter, purchase The New Zealand Herald, Weekend Herald or Herald on Sunday, between Tuesday, June 22 and Monday July, 19, 2010 from a participating Mobil branded store.
a. Complete a "Buy the Herald at Mobil and be in to win a brand new Kia Soul Burner" entry form available at participating Mobil branded stores and attach an original proof of purchase (receipt) and then place in the entry box provided.
OR
b. Send your completed entry form with an attached original proof of purchase (receipt) to "Buy the Herald and be in to win a brand new Kia Soul Burner" promotion, The New Zealand Herald, Marketing Department, PO Box 3290, Auckland City 1140.
In-store entries must be received by store close on Monday, July 19, 2010. Postal entries must be received by 5pm on Wednesday, July 21, 2010. Entrants may enter as often as they wish, but each entry must be on a separate entry form provided at the pint of purchase and accompanied by a separate original proof of purchase (receipt).
5. Each completed and valid entry form will be entered into the draw to win. Entries not complying with these Terms and Conditions, and any late, lost, stolen, misdirected, illegal, incomplete, illegible, damaged, reproduced, or altered entries, will be deemed invalid. NZ Herald reserves the right to verify the validity of any entry.
6. Prize Details: One prize winner will win a red Kia Soul Burner, and all on-road costs including 12 months registration in the name of the prizewinner. The colour of the Kia Soul Burner model and the specifications shown on promotional material may differ to the prize vehicle. Insurances are the responsibility of the winner. The vehicle hand over will take place at a Kia retailer at a time suitable to all parties. The Kia Soul Burner is valued at $ $36,990 NZD.
7. It is the winner's responsibility to cover any travel costs associated with collection of or redemption of their prize. It is also the winner's responsibility to cover any additional costs associated with the prize.
8. The prize draw will take place prior to Friday, August 27, 2010. The winner will be notified by phone and confirmed in writing. If the winner cannot be contacted nor do not claim the prize within 14 days of the prize draw, that winner will forfeit the prize and a redraw will be made.
9. If the main prize-winner drawn is under the age of 18 years, and/or does not hold a full New Zealand drivers license the prize will be awarded to their parent or guardian.
10. The judges' decision is final and no correspondence will be entered into.
11. Prizes are not exchangeable, not transferable and not redeemable for cash. The Herald reserves the right to vary the terms, and to modify, terminate or reschedule the Competition, and to substitute any of the prizes to a similar prize of the same value.
12. Each person who enters the Competition acknowledges that no representations as to the quality or fitness for purpose of the prize has been made by NZ Herald or any representative of the NZ Herald.
13. NZ Herald (and its related companies) accepts no responsibility for late, lost or misdirected mail and will not be liable to any person in any way in relation to this competition or the prize(s) (including but not limited to personal injury) except for any liability that cannot be excluded by law.
14. Each person who enters the competition acknowledges that no representations as to the quality or fitness for purpose of the prize has been made by NZ Herald or any representative of the NZ Herald.
15. All entries become the property of NZ Herald. NZ Herald collects and holds personal information provided with each entry, to be used to notify prize winner, to verify prize winner's identity and, unless otherwise requested may be used for future promotional activities conducted by the NZ Herald. Under the Privacy Act 1993, all individuals have rights to access to and correction of their personal information held by the NZ Herald at 46 Albert Street, Auckland by contacting NZ Herald on 0800 100 888 during business hours. Failure to provide all requested personal information at the time of submitting an entry may result in the entry being invalid.
16. The winner's name and photo may be used for publicity purposes and by accepting the prize the winner must make himself/herself available for this purpose.
