A woman jailed for four years after the death of her baby daughter, has been given permission by the Supreme Court to appeal her conviction.
South African-born Tabbasum Mahomed was found guilty in 2009 of failing to provide the necessaries of life for her 11-week-old daughter Tahani.
In the court's decision, released today, it said leave to appeal was granted based on whether the evidence concerning the child's wellbeing left in the car on December 19, 2007 was admissible and if so, whether the judge's directions relating to that evidence were adequate.
Her husband Azees Mahomed was jailed in December 2009 for a minimum non-parole period of 17 years for murdering Tahani and two counts of causing her grievous bodily harm.
Tahani was admitted to hospital with severe head injuries on December 28, 2007. She died four days later.
