A Whangarei man who bashed another in a random act of street thuggery and stole petrol five times has avoided jail mainly thanks to the efforts of his lawyer.
Vincent Johnson, 22, appeared in the Whangarei District Court for sentencing on Wednesday after pleading guilty to charges of injuring with intent to injure, cultivating cannabis, five of stealing petrol and one of breaching bail.
Judge Duncan Harvey sentenced Johnson to 12 months' home detention and said he had only avoided jail by the narrowest of margins thanks to the efforts of his lawyer, John Day.
Johnson was in the Vine St carpark about 3.37am on September 30, last year, when he was verbally abused by another man. Johnson initially ignored the man, but then turned, circled the man and punched him six times before the victim fell.
Johnson then kicked him twice before walking away. When caught, he told police he hit the man because he didn't "bow down to anybody".
