Australians who visit New Zealand over the next four months may be eligible to join KiwiSaver and claim the Government's $1000 kick-start subsidy.
Anyone can join KiwiSaver if they are a New Zealand citizen - or are entitled to live in New Zealand indefinitely, as Australians are.
The Government is tightening the legislation to ensure those who sign up are genuine New Zealand residents.
But the changes are not due to come into effect until April 1 next year.
Financial planner Michael Littlewood said the loophole illustrated the mess made of the initial legislation because it was rushed.
"Once you start delving down into this level of detail, all sorts of problems start to arise."
The legislative changes are due to be passed by the end of the year.
The second half of the bill's second reading is to be debated in Parliament on Tuesday, and the Government could yet make the legislation retrospective to July 1, which would close the loophole.
