A Family Court warrant ordering that Caitlin Jelicich be handed over to her mother while custody was determined was today quashed by consent in the High Court at Auckland.
The case moves back to Waitakere Family Court tomorrow, where the British government has initiated proceedings under the Hague Convention.
The convention is an international treaty that aims to return children involved in custody disputes to their country of "habitual residence" so custody can be determined there.
Six-month-old Caitlin was born in Wales -- where her mother, Diane Jelicich, lives -- but has dual citizenship.
Earlier this month, her father, Aucklander Stephen Jelicich, went on the run for 10 days with her.
In the High Court this morning, Justice Helen Winkelmann quashed a warrant directing police to take Caitlin from Mr Jelicich and deliver her to his estranged wife. The decision was made with the consent of the parties.
The judge adjourned until February 7 an appeal by Mr Jelicich against a Family Court order allowing Mrs Jelicich to take Caitlin back to Wales.
The couple have come to an agreement about Cailtin's care until the court cases are resolved.
