Education Minister Trevor Mallard said today that Unitec will not become a university.
He said the Auckland-based institute of technology does not meet some of the academic criteria required by the Education Act 1989.
Mr Mallard added: "Unitec did not meet the criteria for advanced learning and the development of intellectual independence, nor the criteria for international standards of research and teaching."
Unitec is seeking a judicial review of the decision.
