Double murder accused Chris Kahui has been granted bail in the Auckland High Court, with the decision to take effect from December 3.
Justice Heath granted Kahui's bail to an address outside the greater Auckland area.
Kahui's lawyer Lorraine Smith said Kahui would be very pleased with the decision.
"I saw his face, he's very relieved, very grateful," Ms Smith said outside court.
Ms Smith said she feared Kahui would be denied bail after events in the recently concluded Michael Curran murder case.
"In the present climate, people are so concerned about those charged with some offence being given bail."
Ms Smith said Kahui had been in solitary confinement since his return to prison, and had had plenty of time to reflect on his previous bail breaches.
Justice Heath said Kahui's detention in solitary confinement had weighed heavily in his decision to grant bail.
The 22-year-old is accused of murdering his twin boys, Chris and Cru.
The trial is expected to be held in May or June next year, and is tipped to run for up to a month. More than 70 prosecution witnesses are likely to be called.
The three-month-olds were admitted to Auckland's Starship hospital on June 13, 2006, with injuries that included brain haemorrhages, broken bones and retinal bleeding.
Both boys died, hours apart, five days later.
Kahui is accused of murdering them while their mother, Macsyna King, was away from their Mangere home.
Kahui has pleaded not guilty to the charges.
