Two train drivers charged in a criminal test case after a freak rail crash in the Wairarapa will face trial in Wellington District Court.
A pre-trial hearing date will be set in May for the first prosecution under Section 7 of the Railways Act 2005.
Steven Clay McIver, 41, of Upper Hutt and Daniel Alois Greene, 50, employees of Toll New Zealand Consolidated, are jointly charged with omitting to do an act in respect of a rail vehicle where they knew, or ought to have reasonably known, that the act or omission was likely to cause death or serious injury to individuals.
A driver was injured last July when empty freight wagons crashed into his ute.
