Teina Pora's Privy Council case will be heard on November 4 and 5 this year.
Pora is about to be released on parole after more than two decades behind bars for the rape and murder of Susan Burdett - something he said he falsely confessed to.
Chief Justice Sian Elias has accepted an invitation to sit on the appeal.
The Judicial Committee of the Privy Council said it was usual practice to invite judges to sit when they are from the countries where an appeal arises, if they are members of the Privy Council.
It also happened in the Mark Lundy case last year.
