The only survivor of the Mt Wellington-Panmure RSA killings, Susan Couch, is suing the Department of Corrections for $2 million.
Ms Couch's lawyer, Brian Henry, told Newstalk ZB he had filed proceedings against the department and a probation officer for malfeasance and negligence.
Ms Couch was seeking $1.5 million in damages for pain and suffering and $500,000 for punitive damages after she was seriously injured in an armed robbery of the RSA in December 2001. Three people were murdered in the attack.
The Corrections Department will defend the proceedings.
