The Solicitor-General says going to the Court of Appeal to seek a retrial of George Gwaze is a possibility.
Mr Gwaze was acquitted of raping and murdering his 10-year-old niece Christchurch girl Charlene Makaza last week after a four-week-trial.
The jury took lass than five hours to reach the not guilty verdict.
Crown Law has confirmed David Collins QC is reviewing the case and he can foreshadow the possibility of a retrial.
Mr Collins will not reveal what grounds an appeal could be based on.
