A man who raped a teenage girl on a Christchurch suburban street has had his jail term reduced from nine years to eight years, by the Court of Appeal.
Gary Shane Ian Nicholas , 29 pleaded guilty in March to sexually violating a 16-year-old girl in June last year.
She was walking with her boyfriend at night in the Christchurch suburb of New Brighton when Nicholas approached them.
He threatened to kill the girl if she did not have sex with him, and then raped her while the boyfriend ran to get help from the nearby Kate Sheppard retirement home.
At sentencing, Christchurch District Court Judge Graeme Noble said Nicholas had raped the girl while she was resisting and screaming.
"Truly, it is a woman's worst nightmare, this kind of rape," he said.
In their decision released today, Justices Ellen France, Ronald Young and Forrest Miller said the sentence was excessive compared with other sex attacks where there had also been additional violence.
They quashed Nicholas's original sentence of nine years and replaced it with one of eight years.
