The Real Estate Institute is taking legal action against a Rotorua business it alleges is operating outside the law.
The Institute says the No Commission Property Sales Rotorua franchise is acting like a real estate agent without being licensed.
Institute president Howard Morley says the franchise's advertising is also misleading, as it tells potential customers that it does not charge a commission, but also does not point out that it charges a fee regardless of whether a property is sold.
Mr Morley says the institute is seeking a High Court injunction preventing No Commission from operating unless it gets a real estate agent's licence.
