KEY POINTS:
A rape victim today challenged a Parole Board decision to release one of her attackers.
The woman, known as Ms A, is seeking a judicial review to release millionaire Peter McNamara on parole in January after serving 2-1/2 years of a seven-year sentence.
The Tauranga businessman, along with ex-police officers Brad Shipton and Bob Schollum, was convicted in 2005 of the brutal pack rape of the woman in Mt Maunganui in 1989.
Ms A's counsel Nikki Pender told the High Court in Wellington that the Parole Board erred in law and failed to take into account relevant considerations when it released McNamara early.
Garth McVicar from the Sensible Sentencing Trust said it was difficult for victims to appeal board decisions, as unless they could fund court action themselves "it's dead in the water".
He hoped the challenge would prompt debate on parole process, he told NewstalkZB.
Four times, the woman has appeared before the board to keep her rapists behind bars.
