Radio station operator RadioWorks and Radio Live programme director Mitch Harris have been charged with breaching a court suppression order in the Louise Nicholas rape case.
RadioWorks says it will plead guilty but that Harris will plead not guilty on advice that RadioWorks is the appropriate defendant.
The prosecution relates to comments made by Harris on Radio Live on May 26.
