A Rotorua District Court judge has allowed publication of details about alleged abuse suffered by three-year-old Nia Glassie.
But the details will remain under wraps after defence lawyer Jonathan Temm appealed Judge Stan Thorburn's decision today.
The appeal will be heard in the High Court at a yet to be determined date.
One of the police's key witnesses, who cannot be identified for legal reasons, gave evidence in Rotorua District Court today via closed circuit television in a depositions hearing for five people charged with the murder and manslaughter of Nia.
Nia died on August 3 in Auckland's Starship hospital from a brain bleed.
Brothers Wiremu, 18, and Michael Curtis, 21, are charged with murder and assaulting Nia between July 18 and 20. Michael Pearson, 19, and Oriwa Kemp, 17, are charged with manslaughter and assault and Lisa Kuka, Nia's 34-year-old mother, is charged with manslaughter by failing to provide medical treatment.
Wiremu Curtis is the former partner of Kuka and was considered Nia's step-father, Oriwa Kemp is Michael Curtis' partner and Pearson is related to the Kuka family.
The Curtis' father, William Curtis, faces a separate charge of injuring with intent to injure relating to alleged abuse between March and July this year.
Mr Temm represents Michael Curtis. The depositions hearing is expected to finish on Friday.
