A Gisborne man with previous convictions for sexual offences against a minor has been sentenced to five years preventive detention for sexually assaulting a 13-year-old boy.
Ivan James Wilson, 29, appeared in the High Court at Gisborne today for sentencing after a jury convicted him on three charges of sexual violation by unlawful sexual connection, three of attempted sexual violation, and three count of performing an indecent act.
Justice Paul Heath said Wilson was released from prison in 2008 after serving a two-year term for sexual offences against a 13-year-old boy.
The sentence, which included sexual offender programmes, was lenient and designed to help Wilson.
But within weeks of leaving jail he was spending time alone with another 13-year-old boy in breach of his release conditions.
Wilson committed sexual offences against the boy between June and December 2008.
He denied the offending and planned to challenge his convictions, said Justice Heath.
Various medical reports were unclear about issues of mental health but Wilson was considered to be at moderate to a high risk of further sexual offending.
Preventive detention was appropriate to protect the community.
Past behaviour was the best indicator of future behaviour, said Justice Heath.
