Double-murder accused Chris Kahui has been spoken to by police over his association with the 8-year-old grand-daughter of his church pastor.
Kahui's involvement with the girl dates back to before he was committed to trial in August on charges of murdering his twin baby boys Chris and Cru in June last year.
His bail conditions state he is not allowed to have contact with children without adult supervision. It is understood Kahui had regular contact with the girl through her mother, who is the daughter of the pastor who took him in earlier this year. It is believed the pastor's daughter is Kahui's new partner.
Police were alerted to this by the girl's birth father, and spoke to Kahui who denied he had been in breach of his bail, claiming an adult had always been present when he was with the 8-year-old.
Kahui's lawyer Michelle Wilkinson-Smith said police didn't plan to take the matter any further at this stage. But she planned to return to court tomorrow to seek an alteration to Kahui's bail conditions to clear up the possibility of any confusion.
One possibility could be that the girl not be allowed to go to the address where Kahui was bailed to, she said.
Kahui was remanded in custody in late August after he breached his bail by drinking alcohol and being in the presence of children at a social gathering. The breaches came barely 24 hours after he was committed to stand trial for the murders of his 3-month-old twin sons. The August violations also followed a final warning for other breaches, including failing to report to police, and failing to answer a bail check.
Kahui is due to be released from jail on Tuesday after being one of the first to take advantage of new bail laws at a hearing last week. He has spent the past six weeks in solitary confinement after receiving death threats from other inmates who had been referring to him as a "baby killer". He will have a 7pm to 8am curfew.
The judge in his case warned him that if he breached his conditions again it was likely he would be returned to custody.
However, had Kahui's involvement with the girl been considered a breach of bail it is unclear under the new law whether bail would have been revoked. The new law puts less emphasis on whether a person has previously breached bail - allowing the court to take that into account only if they are "relevant to whether there is a real and significant risk" of offending, not turning up at court, or interfering with witnesses and evidence. Previous law only required that a "risk" be shown.
Police did not return Herald on Sunday calls.
Chris and Cru died five days after they were admitted to Starship Hospital. They had head injuries and broken ribs, and one had a broken femur. Kahui, who has denied murdering the twins, is due to stand trial on April 21. It is expected to last six weeks.
