KEY POINTS:
Outgoing Whanganui District Health Board chief executive Memo Musa is taking legal action against the board and one of its members Clive Solomon for alleged breach of contract.
Embattled Mr Musa resigned in March after a report by Health and Disability Commissioner Ron Paterson condemned Whanganui DHB for inadequate background checks on a Czech-trained surgeon responsible for numerous botched operations in 2005 and 2006.
Mr Solomon said at the weekend he had heard from his lawyers and expected to be taken to the Employment Relations Authority accused of breaching Mr Musa's confidential settlement.
He said similar action had been taken against the board.
