Anti-capitalist protesters have vowed to fight an application to have some of them arrested.
Last week, a judge ordered members of the Occupy Auckland movement to vacate Aotea Square, where many had been living for ten weeks.
Most moved onto other parks but a few have stayed in the square.
Today the Auckland Council will ask the District Court to imprison them for breaching last week's order.
Occupy Auckland member Chris Glen said that threat hasn't fazed some of the protesters who vowed last night to remain in the square.
