KEY POINTS:
A New Zealand man allegedly involved in a plot to assassinate Fiji's interim prime minister Frank Bainimarama will appear in the High Court in Suva today.
Millionaire businessman Ballu Khan was admitted to hospital in early November after what he says was a beating by the Fijian military.
His lawyer, Peter Williams QC, will submit evidence at 10am to determine whether Khan was lawfully detained.
Mr Williams says Khan will also be suing for substantial damages for unlawful arrest, detention and injuries.
He is understood to be seeking more than $35 million in compensation.
Mr Williams told nzherald.co.earlier this month nz that his client was suffering from "physical and mental conditions".
When asked at the time if the hearing could be fair in Fiji's current judicial climate, Mr Williams said: "One must have a trust in the rule of law. That is essential".
The Ministry of Foreign Affairs and Trade said New Zealand High Commission staff have been able to see Mr Khan when they wish.
Mr Khan is part of a larger group accused of plotting to kill Commodore Bainimarama and senior members of his government.
