A court has ruled that police have failed to prove allegations a young woman driver was texting at the time of a fatal crash.
Amanda Rose, 18, from Carterton, sobbed while a frantic 111 call, made seconds after the crash which killed her mate, was replayed in court yesterday.
Rose appeared in Masterton District Court for a disputed-facts hearing on whether she was texting in the minutes leading up to the accident and whether this contributed to her failure to prevent the crash.
Rose pleaded guilty to careless driving causing death, in an earlier appearance, but denied police allegations of texting.
On February 21, on the southern approach to the Opaki overbridge, Rose lost control of the car she was driving, after the left wheels drifted off the tarsealed road and on to the gravel. Her attempts to correct the car led to a loss of control, with the car rolling and crashing into a fence.
