A Hamilton cyclist who collided with a woman jogger in an underground tunnel earlier this year, resulting in her death in hospital a week later, will not face charges.
Hamilton police say a lack of witnesses to the accident, and of any segregation between cyclists and pedestrians on the shared pathway, was behind the decision, the Waikato Times reported today.
Momoe Sugiyama, 52, was jogging through a tunnel under a roundabout at the corner of Wairere Dr and River Rd on February 9 when she was hit by the cyclist.
The cyclist was halfway through the tunnel when the accident happened and his sight probably would have been affected because he was moving from sunshine into darkness, police were told.
