KEY POINTS:
The lawyer who negotiated the return of medals stolen from Waiouru Army Museum could be removed from involvement in the case against a man accused of the crime.
Last December, 96 war medals, including nine Victoria Crosses, were stolen from the museum. Auckland lawyer Chris Comeskey helped to broker their return, but two men were later arrested and charged with the thefts.
At a Wanganui District Court hearing yesterday, the Crown said it intended calling Mr Comeskey, who is defending one accused, as a prosecution witness, Radio New Zealand reported.
It said the Crown was understood to have a subpoena ready to summons Mr Comeskey to act as a witness, which would mean he could not properly represent the defendant.
Mr Comeskey argued yesterday that the police had no need to call him, and should not.
