A Rotorua man who indecently assaulted a teen boy who went on to try and kill himself will now spend 11 months behind bars, after originally being sentenced to home detention.
Hamiora Kimbo Werahiko, 37, appeared before Judge Maree MacKenzie in the Rotorua District Court last week where his original sentence of 11 months' home detention was cancelled and replaced with a sentence of 11 months' jail.
Judge MacKenzie said there was not a suitable address for Werahiko to serve his sentence so she had no choice but to cancel the home detention, which was delivered on May 5, and replace it with a custodial sentence.
Judge MacKenzie's original sentencing notes, which were released to the Rotorua Daily Post, said Werahiko had been drinking alcohol on a night last year and went to a house at 3am.
The victim was asleep on a mattress in the lounge. Werahiko lay down next to him and indecently assaulted him, waking him up. The victim recognised Werahiko and got up and left the room when Werahiko tried to continue indecently assaulting him.
