A convicted murderer has been granted a judicial review to look into his detention at Rimutaka prison.
Wuti Waa, at the High Court in Wellington last week, sought a writ of habeas corpus which would allow him to go to court to prove he had been unlawfully detained under a final Recall Order.
Waa also wanted to challenge the basis on which two Parole Board decisions were made.
In 1990, Waa was sentenced to life imprisonment for murder and concurrent terms for aggravated robbery and aggravated wounding.
While in jail, Waa received another six-month sentence.
Upon release in 2002, he was liable for recall to prison for the rest of his life. In September 2003, an application for his recall was filed following a spate of offending. Inconsistent dates were filed on some of the ensuing paperwork.
Waa is challenging the validity of the warrant and the Recall Order, suggesting both were backdated.
