Double murder accused Chris Kahui is behind bars as he waits for his trial to go ahead after breaching his bail for a third occasion.
Kahui breached his bail by drinking beer and being in the presence of two children under three years of age last Thursday, a Manukau District Court hearing found today.
He was remanded in custody until his trial, which is scheduled to begin in May next year.
Kahui's lawyer Michele Wilkinson-Smith argued the accused had only had one swig of beer and that he had tried to leave the house he was visiting once he realised the children were present.
But Judge James Rota found that Kahui had breached his bail on both counts alleged by police prosecutor Simon Mount.
Kahui had earlier not reported to a police station once, as he incorrectly believed it was a public holiday and he did not need to report, and did not answer his door once when police arrived late at night as he was asleep.
Ms Wilkinson-Smith had argued he should be bailed on a 24-hour curfew.
Kahui is charged with murdering his three-month-old twins Cru and Chris in June last year.
