A South Auckland man accused of murdering his twin babies has breached the conditions of his bail in what he claims was a public holiday mix-up.
Chris Kahui, 21, is on bail while he defends a charge of murdering his 3-month-old sons Chris and Cru in south Auckland last June.
Appearing in court on behalf of Kahui's lawyer Lorraine Smith, Louise Freyer told the court that Kahui had mistakenly thought it was a public holiday on Monday this week, when he failed to check in with police.
A condition of Kahui's bail was to report to Glen Innes police on Mondays and Wednesdays, except on public holidays, she said.
"He mistook the Queen's Birthday Monday for this Monday that's just past.
"He apologises to the court and will ensure this does not happen again."
Judge Robinson told Kahui: "I'll take into account your explanation but it is a little bit thin. "[There] is plenty of notice for public holidays ... and I find it rather remarkable that you've made that mistake. Don't make it again if you don't want to end up in custody."
Speaking to the Herald after Kahui's appearance, Lorraine Smith said her client called her on Tuesday to say he had forgotten to report to police.
"When I told him it wasn't Queen's Birthday until next Monday he was shattered. He just could not believe it . . I said 'get yourself down to the police station immediately'."
Mrs Smith said Kahui went to the station where it is understood he was arrested.
Kahui's next court appearance is in August.
