Two men who ran an unlawful lottery which delivered only one of the 27 cars promised as prizes will be sentenced later this month.
Richard Stuart Hayes and Troy Jonathon Elliott were found guilty in a reserved decision released in August after a hearing in February and were due to be sentenced in Auckland District Court yesterday.
However, Judge Nicola Mathers delayed the sentencing for a fortnight so she could see more financial documents.
The men were directors of the Watch and Win company and organised the TxtDrive competition in March, 2004.
Several parties were involved, including Pizza Hutt and advertising agency McCann Erickson, but only Hayes and Elliott were charged.
During the competition cellphone users were urged to text the word of the day to be eligible to win a Peugeot car. Each call cost 99c.
The competition failed to generate the expected income and the organisers received only $414,595. Only one of the winners received a car.
