North Shore man Mark Tipene will not stand trial over allegations of indecent assault stemming from an incident in an Orewa hotel room in November last year.
Tipene's lawyer Gary Gotlieb argued in the Auckland District Court on Tuesday that there was insufficient evidence to prove the incident did not involve the woman's consent and the case was dismissed.
