The parents of an 18-month old toddler in hospital with broken bones have gone to the High Court in their fight to stop their names being published.
The couple was charged with wilfully neglecting their son, who is still in hospital with a broken thigh and a broken arm.
The couple, aged 27 and 29, appeared in Waitakere District Court in west Auckland last week when Judge Phil Recordon threw out their bid to continue a name suppression order.
However, he said it would not expire until 4pm today to give them time to tell others of the charges and to consider an appeal.
Today the couple's lawyer confirmed an appeal had been filed with the High Court in Auckland but that no date had been set for a hearing.
The toddler was in hospital for the second time with broken bones. When he was four months old he was taken to hospital with a broken arm.
The infant was admitted on June 23 with a broken thigh and broken arm which doctors believe happened up to 10 days earlier.
The couple is due to appear again on August 30.
