A man who is HIV-positive was yesterday found guilty of having unprotected sex with his unsuspecting former partner.
Justin Dalley, 35, had initially admitted to a criminal nuisance charge of endangering the victim's health last year by not telling her, but applied to change the plea to not guilty when the victim told his lawyer she had lied.
Wellington District Court Judge Mike Behrens, QC said the unemployed Lower Hutt man had admitted he had unprotected sex with the victim and believed he had not told her.
