KEY POINTS:
Two Gisborne Mongrel Mob associates have had their convictions for manslaughter quashed and now face a retrial.
Albert Tipu Atkins and Poi Colin Taylor were found guilty in July last year of Black Power member Anton Newcomb's manslaughter.
Mr Newcomb was stabbed to death outside Gisborne's Irish Rover bar in August 2005.
Ossie Paretene Aupouri was also found guilty of manslaughter, while Juan Marcus Arron Sullivan was found guilty of murdering Mr Newcomb.
The Court of Appeal this month allowed the appeal of Aupouri, quashing his conviction and ordering a retrial.
In a decision released today, the court said the Crown accepted that the position of Atkins and Taylor could not be distinguished from that of Aupouri.
Atkins and Taylor were part of a group who attacked members of the rival Black Power gang with fists, boots and bottles.
In the course of the attack, Sullivan stabbed Mr Newcomb with a knife, killing him.
The appeal court said there was no evidence at the trial that Atkins and Taylor knew the killer was carrying a knife.
