The Filipino man at the centre of an overstayer row has temporarily stopped working at the Silverdale clothing factory north of Auckland where he has been employed for the last six months.
Oscar Mila, his wife and daughter were wrongly expelled from New Zealand on Tuesday after a dawn raid on their home, but were immediately flown back.
However, Immigration Minister Lianne Dalziel says the firm that employs Mr Mila is breaking the law.
Owner Vicky Larsen says she sought advice and has been advised by Mr Mila's solicitor to send him home while the matter is resolved.
She says he does not have the work permit, she thought he had.
