A council investigation has cleared the owners of an apartment where the brother of TV3 weather presenter Toni Marsh suffered fatal injuries.
Auckland DJ Glenn Marsh died on Tuesday after more than two months in an induced coma following his fall from the first-floor terrace of a flat owned by property developer David Southcombe and his fiancee, TV star Aja Rock.
Auckland City Council building control officer Ian McCormick said the building was being redeveloped and the work had building consent. "No illegal structure nor non-compliant building work contributed to the accident.
"Unfortunately at the time of the accident the building works had not been completed and the balcony that was planned and approved for the area had yet to be erected.
"It is uncertain whether the presence of this barrier would have prevented the accident."
Marsh, a 37-year-old DJ at Viaduct bar Soul, was attending a Friday night party that carried on well into Saturday morning. He fell about 11am.
A statement from his family this week said he was "much loved and admired".
"This was shown by the constant stream of visitors to his bedside during the nearly 10 weeks he was in hospital. "
