A man who allegedly drugged and raped a woman escort after he was given electronic bail to live at a holiday park north of Auckland has been told by a judge to get another lawyer.
Paulus Nieuwenhuiysen, 49, appeared in the Auckland District Court today charged with stupefying and raping the 23-year-old woman after inviting her to his unit at the Waiwera Holiday Park and Thermal Pools. He is also charged with aggravated wounding and possession of methamphetamine.
Judge David McNaughton told lawyer, Shaurya Malaviya, acting on instructions from Evgeny Orlov, that there didn't seem to have been any progress made since August 3.
Mr Malaviya told the judge that a letter had been sent by Mr Orlov to the Crown objecting to evidence obtained.
But Judge McNaughton replied that the letter was completely inadequate and was not what was expected.
"Where is the application for severance of the indictment which I directed to be filed within 14 days with submissions in support?
"I told Mr Orlov it was not in the correct form last time. He's had a month to sort this out. Neither you or he has any idea what they are doing," Judge McNaughton told Mr Malaviya.
He told Nieuwenhuiysen to "get somebody who is competent" or he would refer the case to the Law Society.
"Mr Orlov has made a complete mess of this so far," Judge McNaughton said.
Nieuwenhuiysen was remanded on bail and is due to reappear in the Auckland District Court again next month.
Mr Malaviya would not comment outside court.
